Keep the home sale organized through a difficult transition.

When a shared home is part of a separation, clear instructions and consistent information matter. We handle the property work alongside the legal direction you receive from your attorney.

What should we decide before selling a home during divorce?

First have your attorney confirm who can authorize a sale and whether agreements or court orders apply. Then establish a communication plan, a pricing process, a preparation budget and instructions for reviewing offers. Real estate representation does not determine ownership rights or how proceeds are divided.

Get authority and communication clear

Before marketing begins, we need to understand who is authorized to give instructions and what approvals are required. Legal counsel determines the effect of court orders or agreements. We do not advise either party on divorce terms.

Set expectations for updates, showings, access and decisions in writing. A shared factual record can reduce confusion about what was proposed, what was approved and what remains unresolved.

Price the property using the same evidence

A useful property review separates an asking-price strategy from an appraisal or legal valuation. We review comparable sales, condition and current competition with the authorized decision-makers. If a formal appraisal is needed, discuss that with counsel and a qualified appraiser.

For a Peninsula or South Bay home, compare the relevant micro-market rather than broad county averages. Lot configuration, improvements, maintenance and the competing homes available to buyers can materially change the pricing discussion.

Agree on the practical details before launch

Decide what preparation is permitted, how vendors will be paid, how belongings will be handled and when the property can be shown. Work backward from possession needs and any attorney-confirmed deadlines.

When offers arrive, compare financing, contingencies and possession along with price. Escrow should receive approved disbursement instructions through the proper channels. Questions about a buyout, taxes, refinancing or the division of proceeds belong with your legal, lending and tax advisors.

Before the first conversation

  • Ask counsel to confirm sale authority and any restrictions.
  • Agree on a written communication and approval process.
  • Review comparable sales and decide whether an appraisal is needed.
  • Set a preparation budget, access plan and possession expectations.
  • Have the appropriate professionals confirm instructions for escrow and proceeds.

Questions before you decide

Can one spouse list the home without the other?

That depends on ownership, authority, agreements and court orders. Your attorney must resolve those questions before we accept instructions to market the property.

Will the agent decide how the sale proceeds are divided?

No. Ownership rights and division of proceeds are legal matters. The real estate team works from the authorized instructions provided through the proper legal and escrow channels.

Can we compare selling with a buyout?

We can provide a market-based property review for the comparison. Your attorney, lender, appraiser and tax advisor should assess the legal, financing, valuation and tax requirements of a buyout.
